Fern Client — Terms of Service

These Terms of Service ("Terms") apply to the Fern Client launcher, the Fern in-game mod ("fern-core") and related Fern services (together: "Fern"). Fern is made by [OPERATOR NAME] ("we", "us"). Contact: [CONTACT EMAIL].

By installing or using Fern you agree to these Terms and confirm that you have read our Privacy Policy. If you do not agree, do not install or use Fern.

1. Not an official Minecraft product

Fern is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. "Minecraft" is a trademark of Mojang Synergies AB.

To play you need your own legitimate copy of Minecraft: Java Edition. Your use of Minecraft is governed by the Minecraft End User License Agreement (EULA) and the Minecraft Usage Guidelines, which you must accept and follow.

2. Your licence to use Fern

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Fern for your own, non-commercial use. You may not:

  • sell, rent, re-distribute or publish Fern or modified versions of it;
  • remove or change copyright notices or branding;
  • reverse engineer Fern to build cheats, bypass server protections or harm other players;
  • use Fern in a way that breaks the law or the rights of others.

3. Fair play

Fern only offers features that are meant to be allowed on major servers. You are responsible for following the rules of every server you join. Server owners may restrict features, and Fern may disable features automatically on certain servers. We are not responsible for bans or penalties you receive from server owners, Mojang or Microsoft.

4. Your Microsoft / Minecraft account

You sign in with your Microsoft account through Microsoft's own login page. We never see or store your password. Login tokens are stored on your device only (see the Privacy Policy). You are responsible for keeping your Microsoft account and your device secure.

5. Third-party mods and content

Fern lets you download mods, modpacks and other content from third parties such as Modrinth. That content is provided by its own authors under its own licences and terms. We do not control it and are not responsible for it. Install third-party content at your own risk.

6. Cosmetics and Fern Coins (when available)

Fern may offer cosmetics, some free and some for "Fern Coins".

  • Fern Coins and cosmetics are a limited licence to use virtual items inside Fern. They have no real-world monetary value, cannot be exchanged for money and cannot be transferred or sold.
  • Cosmetics never give a gameplay advantage.
  • If you are under 18, you need permission from a parent or guardian before buying anything.
  • Your statutory rights as a consumer (for example the EU right of withdrawal) apply. When you ask us to deliver digital content immediately, you may lose the right of withdrawal for that content, as explained at checkout.
  • Detailed purchase terms will be shown at checkout.

7. Updates and availability

Fern may update itself automatically to fix problems, stay compatible with new Minecraft versions and keep you safe. We may change, suspend or stop (parts of) Fern at any time. Fern is provided "as is" and "as available".

8. Liability

To the extent permitted by law, we are not liable for indirect damages, lost data (such as worlds), account bans or problems caused by third-party content. Nothing in these Terms limits liability that cannot be limited by law, and your mandatory rights as a consumer are not affected.

Always keep backups of worlds that are important to you.

9. Ending your use

You can stop using Fern at any time by uninstalling it. We may end or suspend your access if you seriously break these Terms, for example by using Fern to cheat or harm others.

10. Changes to these Terms

We may change these Terms. If the changes are important, Fern will ask you to accept the new version before you continue using it.

11. Applicable law

These Terms are governed by the laws of the Netherlands. If you are a consumer living in another country, you keep the protection of the mandatory consumer laws of your country, and you may also go to the courts of your country.
